European Union and International Law

“Some day, following the example of the United States of America, there will be a United States of Europe.” George Washington

As a member of the European Union and party to many international conventions and organizations, Bulgaria is subject to European/international principles and legislation even in cases of purely internal situations, not mentioning cross-border disputes or projects. Our lawyers ensure that their clients are kept abreast of developments in European and International law and compliant with the rulings of the European Court of Justice, Luxembourg (ECJ), the ECHR, Strasbourg and other supranational jurisdictions.

Eurolex Bulgaria advises on all areas of European law, with a particular focus on EU competition, intellectual property and public procurement law. Among our services in this area are:

  • advising on the application of Bulgarian law in the light of European legislation
  • researching EU regulations, directives, decisions and cases in the European Court of Justice and the European Court of Human Rights for developing strategies in disputes
  • representing clients before Bulgarian and European courts and in arbitration proceedings concerning EU matters
  • assisting clients in their application for EU subsidies, in EU projects and in seeking financing from donors such as the European Bank for Reconstruction and Development
  • determining jurisdiction and applicable law and representing clients in international disputes
  • assisting clients with the recognition and enforcement of foreign judgments in Bulgaria and national judgments abroad
  • advising on state aid issues as regulated by EU law

Eurolex Bulgaria is dealing with European Law assignments even prior the accession of Bulgaria to the EU in 2007. The experience of Mr. Andrey Delchev as head of the Programme Management Unit for implementation of PHARE project in the government and our participation in procedures for harmonization of different national acts with acquis communautaire gave us fair advantage at the time entering the European legal order. It is our consistent policy to enroll our lawyers in seminars, courses and events devoted on European issues in order to be fully aware of all the changes in the legal basis of the Union. We strongly supported group of our associates when they were selected as local partners of University of Cambridge for the organization of the annual Moot Court Competition on EU law in Sofia in 2010 and also when they participated and won the same competition in Poland in 2008. As a consequence, we are now able to depend on experts who excellently deal with analyses for harmonization and application of European acts (Regulations, Directives, Decisions etc.) despite the fact that EU law and its impact on national law is relevantly new for the Bulgarian legal society.
